Right Of Way Permit

Applications need to be completed for work in the right away such as curb cuts, sidewalk repair, street excavation or water and sanitary sewer service.

*The applicant must have a GOPHER STATE ONE CALL (GSOC) ticket number assigned before work can begin.  The GSOC phone # is 1-800-252-1166.  GSOC will notify only utilities within the project area.  The GSOC call must be made at least 48 hours (excluding weekends, holidays, and emergencies) prior to the start of digging.*

Special Provisions

  1. A deposit in the amount of $3,000 is required before work can begin.
  2. The street surfacing will be cut prior to excavation.
  3. The excavation will be back-filled with dry material capable of being compacted, fully tampered, for the depth and length of the trench, up to one foot of the top of the excavation.
  4. Fill shall be compacted with lifts not to exceed 6-12 inches.
  5. Crushed gravel will be placed and fully tamped to match the top of the existing base.
  6. Surface Material will be replaced to match existing material. If unable due to the availability, 4” of bituminous milling or concrete would be required temporarily until matching material can be placed.
  7. The contractor shall provide all barricades, flashers, etc., which may be required to protect the public
  8. The contractor will hold harmless the City of Chatfield from all claims of personal injury liability, death liability, or property damage liability which might arise during the execution of the above-stated work.
  9. Installation of new, or repair of existing driveway must not change the previously established flow line of gutter.
  10. Applicant must notify City Hall when work is completed and ready for inspection.

What is a right of way?

A right of way is the publicly owned area in a development or neighborhood that extends beyond the back of the curb into the residential or business yard. A common misconception is that the homeowner’s or business owner’s property line goes right up to the curb. It does not. The public owns a certain amount of the land behind the curb (right of way). The size of the right of way is not always the same for every property. 

The right of way is important for the installation and maintenance of streets and private and public utilities, including electrical, phone, sewer and water, and storm sewer lines. The right of way area behind the curb is also used for snow storage when the city plows streets. The city administers the use of this area through a permitting process.
